Portugal’s ERSE Shifts More System Costs Onto Producers

Portugal’s regulator ERSE has put a new cost-allocation directive out for consultation: producers will finance roughly 35% of the €137 million social tariff bill for 2026, at 0.283 €/(kVA.month), retailers the remaining 65%.

It’s a small line item on its own. But it’s exactly the kind of change that a Project Development Services Agreement exists to catch before it surprises a sponsor at financial close. Regulatory cost allocations move every year, in every market we work in, and a business case built on last year’s assumptions is already out of date.

It’s a discipline of re-checking tariff structures, grid charges, and system-cost allocations at every stage, and folding them back into the model before an investor or IPP ever sees the numbers.

Producers picking up a growing share of system costs is a pattern we’re watching across several jurisdictions, not just Portugal’s. The developers who price it in early keep their financing timelines intact. The ones who don’t renegotiate late, under worse terms.
